LENDIT TERMS & CONDITIONS

These Terms & Conditions including the Lendit Guarantee and our policies (“Terms”) govern your access to and use of the Lendit platform, including the Lendit website, mobile applications, and related services (the “Platform”).
Lendit provides a digital peer-to-peer marketplace enabling users to lend and borrow items from one another. Lendit does not own, supply, sell, hire out, inspect, or control any items listed on the Platform.
By accessing or using the Platform, you agree to be bound by these Terms and specific limitations set out on the website. Lendit reserves the right to limit the total value of items any individual User may list or borrow and the value of any individual items which any User may list or borrow.
1. Definitions & Interpretation
1.1 Definitions
“Lendit” means Lendit Local Ltd (Company No. 16387022) whose registered office is at The Old Rectory, Mucking Wharf Road, Stanford-Le-Hope, Essex, SS17 0RN.
“User” means any person registered on the Platform.
“Lender” means a User who lists an item for rental on the Platform.
“Lendit Guarantee” means the item protection scheme described below.
“Listing” means an item advertised on the Platform.
“Policies” means the Privacy Policy, Anti-Slavery Policy and other policies available on our website concerning the relationship between Lendit and our Users.
“Renter” / “Borrower” means a User who books an item to rent under a Rental Agreement.
“Rental Agreement” means the legally binding agreement formed directly between the Lender and the Renter.
“Rental Period” means the period from the date of this agreement or collection of the item subject to the Rental ‘Agreement until its return (or twenty days following the date when it was due to be returned).
1.2 Interpretation
In these Terms:
Words such as including and in particular are illustrative only.
References to persons include individuals and legal entities.
References to writing include electronic communications via the Platform.
2. Platform Role & Intermediary Status
Lendit acts solely as a neutral platform facilitator. It may limit or refuse access to the website at Lendit’s sole discretion.
Rental Agreements are formed directly between Lenders and Renters. Lendit is not a party to any Rental Agreement and does not assume responsibility for:
• Item condition, safety, legality, or suitability
• Accuracy or completeness of Listings
• User conduct or behaviour
• Performance or enforcement of Rental Agreements
• Disputes between Users
Except as expressly stated in the Lendit Guarantee, Lendit disclaims all liability relating to Rentals conducted via the Platform, to the maximum extent permitted by law.
Lendit does verify the identity of Users but does not check their background, qualifications, or conduct and does not inspect items listed on the Platform.
3. Eligibility, Registration & Accounts
Users must be natural persons aged 18 or over.
By registering, you confirm that all information provided is accurate, complete, and kept up to date. You are responsible for:
• Maintaining the confidentiality of your login credentials
• All activity conducted through your account, whether authorised or not
You must notify Lendit immediately of any unauthorised use or security breach.
Lendit may suspend or terminate accounts where information is inaccurate, misleading, incomplete, or fails identity, compliance, or security checks.
4. Account Use & Restrictions
Users agree not to:
• Post false, misleading, outdated, or unlawful information
• Harass, abuse, threaten, insult, or behave discourteously towards other Users
• Send unsolicited commercial communications (spam)
• Interfere with the Platform’s operation or security
• Scrape, harvest, data-mine, or aggregate Platform content, listings, or data using automated tools, bots, spiders, or similar technologies
Lendit may suspend or terminate Accounts for breach of this section.
5. Listings
5.1 Listing Accuracy
Lenders are solely responsible for ensuring Listings:
• Are accurate and not misleading
• Comply with applicable UK laws
• Correctly describe condition, value, and permitted use
• Have a maximum rental period of 60 days
5.2 Prohibited Content
Listings must not include content that is unlawful, offensive, discriminatory, defamatory, pornographic, political, infringing, or misleading.
5.3 Moderation
Lendit may edit, amend, remove, or disable Listings to ensure compliance or meet legal obligations.
6. Bookings, Payments & Fees
6.1 Payments
Payments are required at the time of booking and are processed by Stripe. Users must comply with Stripe’s KYC, AML, and sanctions requirements.
6.2 Holding, Wallet & Payouts
Rental fees are charged at booking and held during the rental period. After deduction of applicable fees, funds are credited to the Lender’s platform wallet.
Wallet funds may be withdrawn or used for future rentals, subject to checks and thresholds.
Circumventing the Platform (including off-platform payments) may result in immediate termination and a charge equal to three times the amount circumvented (based on the assumption that you will have circumvented multiple times by the time you are caught).
6.3 Fees
All fees are disclosed prior to booking. Fees are non-refundable unless required by law or expressly stated otherwise.
7. Cancellations, Late Returns & Non-Return
• Renters must notify the Lender via the Platform if an item cannot be returned on time.
• Where an item is returned late, the rental period will be automatically extended, and a charge equal to one full day’s rental rate for each commenced day overdue will apply for a maximum of 20 days.
• Any late return charges will be held by Lendit until the item is returned, after which the applicable amount will be credited to the Lender’s platform wallet, less Lendit’s usual fees.
Non-Return of Items
• If an item is not returned and remains overdue for 20 consecutive days or more, it may be classified as permanently not returned.
• In such cases, Lendit may collect the stated replacement value of the item from the Renter’s stored payment method, together with any applicable late return charges accrued or may recover such charges by other means. The Renter shall indemnify Lendit against the costs of any such successful recovery action.
• Upon recovery of the total replacement value of the item (taking into account the late return charges) the Renter shall be treated as having purchased the item from the Lender.
• The total amount collected (excluding costs) will be used to compensate the Lender for the item, with the Lender receiving the item’s replacement value less an amount equivalent to twenty (20) days’ rental, which represents the maximum late return charge retained.
• Any amounts credited to the Lender remain subject to Lendit’s usual platform fees and the Lendit Guarantee.
• Failure to return an item will, in most cases, result in suspension or permanent removal of the Renter’s account, at Lendit’s discretion.
8. Item Use, Damage & Responsibility
Renter Responsibilities
• Renters must take reasonable care of items, use them only for their intended purpose and in a safe manner (where recommended, with suitable safety equipment) and return them in the same condition as they were at collection, allowing for fair wear and tear.
• Renters must promptly report any loss, damage, malfunction, or defect to the Lender via the Platform. Failure to report any damage, malfunction or defect within 48 hours of collection shall be give rise to a rebuttable presumption that the damage, malfunction or defect was caused by the Renter.
• Renters must not attempt to repair, alter, conceal, or continue using damaged or faulty items, nor arrange third-party repairs, unless expressly authorised.
• Failure to report damage or unauthorised repairs may result in liability and may invalidate protection under the Lendit Guarantee. The Renter shall indemnify the Lender for all costs arising from breach of these Terms.
• The person making the booking remains responsible for the item, even if another person uses it.
• Renters shall not sub-hire or sell items rented pursuant to a Rental Agreement.
Lender Responsibilities
• Lenders must ensure items are safe, functional, properly maintained, and fit for their intended purpose at the time of handover.
• A Lender may be held legally responsible for loss, damage, injury, or death arising from knowingly lending an item that is faulty, unsafe, improperly maintained, or misrepresented.
• Lenders are solely responsible for determining, reporting, and paying any taxes, duties, or fees arising from rental activity under UK law.
Lendit does not accept responsibility for injuries or losses caused by items supplied by Lenders, except where liability cannot be excluded by law
9. Disputes & Mediation
Users should attempt to resolve disputes directly.
If unresolved, Users may request Lendit to mediate. If mediation is provided, Users agree to accept Lendit’s determination for Platform purposes only.
10. User-Generated Content
Users remain solely responsible for all content they upload.
By uploading content, Users warrant that such content:
• Is lawful and accurate
• Does not infringe intellectual property or privacy rights
• Is not defamatory, obscene, or misleading
• Does not contain malware or harmful code
Users grant Lendit a royalty-free, worldwide, perpetual, irrevocable licence to use, reproduce, adapt, publish, and promote such content.
Lendit may remove or modify content at its discretion and assumes no liability for User content.
11. Indemnity
Users agree to indemnify and hold harmless Lendit, its directors, employees, and agents from all claims, losses, liabilities, costs, and expenses arising from:
• Breach of these Terms
• User content or Listings
• Misuse of the Platform or Account
• Interactions or disputes with other Users
• Unauthorised account access or fraudulent activity
12. Release of Claims
To the maximum extent permitted by law, Users agree that:
• Any dispute arising from a Rental Agreement lies solely between the Lender and Renter
• Lendit shall not be liable for any claim, loss, or damage arising from User-to-User transactions
13. Platform Availability
The Platform is provided “as is” and “as available”. Lendit does not guarantee uninterrupted access and may suspend availability for maintenance, updates or circumstances beyond its control.
14. Suspension & Termination
Lendit may suspend or terminate accounts without notice where:
• These Terms are breached
• Fraud, misuse, or illegal activity is suspected
• Abuse of the Lendit Guarantee is suspected
• User conduct threatens the Platform or its Users
15. Data Protection
Lendit acts as data controller for personal data processed via the Platform. Data handling is governed by Lendit’s Privacy Policy and applicable UK GDPR requirements. 16. Limitation of Liability
To the maximum extent permitted by law Lendit excludes and disclaims liability for direct or indirect losses arising from Platform use and/or from the use of any items rented pursuant to any Rental Agreement save to the extent covered by the Lendit Guarantee. Nothing in this agreement excludes liability for death, personal injury, fraud, or non-excludable statutory rights for which Lendit would otherwise be liable.
17. Lendit Guarantee
In the event that any Lender shall not have an item returned (or if it is returned in a seriously damaged condition caused by a Renter) Lendit shall pay to the Lender an amount equal to the listed value of the item (after deducting any additional rental payments over the originally specified rental period which shall have been or which are to be paid to the Lender). The Lender agrees that payment of such sum shall be treated as conclusion of a contract of sale of the item to Lendit and the Lender assigns all rights it may have against the Renter of such item at the point of sale to Lendit absolutely. This guarantee is conditional upon the Lender not having taken any action to alienate, assign or waive its rights against the Renter at the point of sale and the Lender undertakes to inform Lendit if it has taken any such action which might have terminated its right to this guarantee. Failure to inform Lendit of any such action shall entitle Lendit to recover the amount of any payment made under this guarantee together with interest and all costs associated with such recovery.
17. Entire Agreement & Severability
These Terms constitute the entire agreement between Users and Lendit concerning Platform use.
If any provision is held unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in force.
18. Changes to Terms
Lendit may update these Terms from time to time. Continued use of the Platform following publication of updated Terms constitutes acceptance by the User of our new Terms.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
